K. Personnel Security and Suitability Requirements
Fingerprint Screening and Background Investigations
Performance under this contract will require Contractor and subcontractor employees to have routine access to IHS-controlled facilities or systems.
Before beginning work requiring such access, each individual shall complete an FBI National Criminal History Check (fingerprint check) and receive a favorable adjudication from an authorized IHS official through the agency-designated process.
The Contractor shall allow five business days for IHS processing of fingerprints submitted electronically at an IHS site and thirty business days for non-electronic processing using FBI Form FD-258. A list of IHS sites with electronic fingerprinting capability is available from the Contracting Officer.
Contractor personnel shall coordinate with the Service Unit Background Coordinator or other designated official to complete and submit all required background investigation questionnaires accurately through the system designated by IHS. Required submissions shall be completed before the individual begins performance under this contract. Computers are available at the service unit for this purpose.
Exclusion Screening
No Contractor or subcontractor employee listed on the Department of Health and Human Services Office of Inspector General’s List of Excluded Individuals/Entities (LEIE) shall perform work under this contract.
The LEIE is available at https://exclusions.oig.hhs.gov.
As soon as practicable, and before performance begins, the Contractor shall provide the Contracting Officer with the names of all individuals proposed to perform work under the contract for screening against the LEIE.
During contract performance, the Contractor shall provide the names of any additional or replacement personnel to the Contracting Officer for screening before those individuals begin work.
Contractor Responsibilities
The Contractor is responsible for conducting personnel security prescreening sufficient to ensure that each Contractor or subcontractor employee referred to IHS is not listed on the LEIE and can obtain a favorable fingerprint clearance.
Prescreening shall be completed sufficiently in advance of the anticipated start date to avoid delays resulting from denial of access.
For time-and-materials, labor-hour, or cost-reimbursement contracts, the Contractor shall not charge the Government for labor hours or other costs associated with personnel who cannot perform because of denied access, including additional time required to resolve unfavorable security findings.
For fixed-price contracts, denial of access resulting from unfavorable security findings shall not constitute an excusable delay or a basis for increasing the contract price.
Investigation Costs
The Government will pay the cost of processing Contractor personnel suitability investigations. However, if multiple investigations are required for the same position, the Contracting Officer may reduce the contract price by an amount not exceeding the cost of the additional investigations.
L. Protection of Children and Required Training
All Contractor healthcare providers shall comply with the Indian Health Service policy, Protecting Children from Sexual Abuse by Health Care Providers, located in the Indian Health Manual, Part 11, Chapter 2:
https://www.ihs.gov/ihm/pc/part-11/p11c2/
Contractor personnel shall review the policy and complete the required agency-approved training before patient contact or entry into patient care areas, as applicable, and complete required annual training.
Training materials and completion instructions are available through the service unit or the Contracting Officer.
M. Solicitation Preparation Costs and Government Authority
This solicitation does not obligate the Government to reimburse any costs incurred in preparing or submitting a quotation.
Only the Contracting Officer has authority to legally commit the Government to the expenditure of public funds in connection with this acquisition.
N. Invoice Processing Platform
The Indian Health Service uses the Department of the Treasury’s Invoice Processing Platform (IPP) for electronic submission and processing of payment requests.
Invoices under any resulting contract shall be submitted electronically through IPP in accordance with applicable HHSAR requirements.
Contractors that do not already have an IPP account are encouraged to register before contract award.
An offeror that believes use of IPP would be unduly burdensome shall include a written explanation with its quotation for consideration by the Contracting Officer.
O. Quotation Acceptance Period
Each quotation shall state that it is based on the terms and conditions of this RFQ and identify any exceptions.
The quotation shall also state that its pricing will remain firm for at least 60 days from the date the quotation is received by the Government.
